Nope, you are locked as unable to hit or op the kd for 96h, regardless of whether both leave eowcf early or not.
Caveat: We found during the AMA stuff that if they warred a second kingdom and then entered EOWCF with them prior to the 96h EOWCF ending, that they could hit us, and we could not retal. It was reported as a bug at the time, but I don't know if it was ever fixed.

There was no punishment for it.
They legitimately warred rage :p. They only made like 3-4 hits into us before the bug was realized, but there were also negotiations to end the whole thing at that time.
Additionally, they apparently thought the 96h was up -- it was a tick early, so they only had a 1 tick advantage on us :).

Indeed, it wasn't a big deal in terms of impact. I just hope it was fixed.
well at a minimum, if its a known bug and people abuse it the in theory the dev's will do.....something.....
