The law does not recognize ghost crimes. The law is a system based on shared awareness of a certain occurrence between human beings. If only 1 knows and does not share it, it is simply part of his conscience and not the law.

The act in itself is against the law.

Depends on where you are and your conception of the law. My conception of the law is that it only applies as far as it can be enforced. In other words, it is a set of agreements between certain people living in a certain territory that you do not do certain stuff. People who do not agree with that, or choose to ignore it, are called "Criminals". The majority has pooled it's resources to make sure "criminals" are "punished" by removing them from society (temporarily or conclusively), inflicting physical pain, or forcing them to part with a part of their belongings. In other words, the law only holds so far as it can be enforced. In placed it cannot be enforced it does not exist (Lawlessness).

But it is against the law to kill someone.
There is no murder without a conviction.

I'm detective BoH, this is my partner detective Korp. We are here investigating the murder of Bart, what was your last interaction with him?

It's murder prior to even having a suspect let alone conviction. You're attempting to argue semantics, possibly going the rout it's just death without proof it is unlawful and thus murder but that is incorrect.

Murder is an action that can only be evaluated in an absolute sense (did or did not occur) by people aware of it (or it's possible existence). If Korp is the only one who knows about Bart's murder (was it Bart?) then, well, how true is a truth known only to a single man... especially one who won't confirm it.

Problem is that the law distinguishes between murder and manslaughter for instance. So until the "law" knows what happened, it's still up in the air whether something was murder or not according to the law.
