This would probably be true if this was a single incident that happened and would likely not happen again in the near future. However, the reputation of the KD at hand, their affinity for such behavior and so on suggest that these offenders are likely to repeat the offense unless the punishment was more severe. It works the same way in real life law (I'm not a law student or very familiar with it but I know that much).
